These website terms do not replace a signed school agreement. If there is a conflict, the signed Order Form, service agreement and DPA apply to the contracted service.
1. Provider and acceptance
TOP Learning Engine is operated by EEP EdTech For Education & Training Computer Software, Dubai professional licence no. 1658891 (“EEP EdTech”, “we”, “us”). By accessing the website or an authorised account, you agree to these terms and confirm that you have authority to act for your organisation where applicable.
2. The service
TOP Learning Engine provides modular software for school planning, classroom workflows, assessment, operations, improvement and learner support. Activated modules, users, storage, support level, subscription term and fees are specified in the school’s Order Form.
Demonstrations, prototypes and development-vision features shown on the website are illustrative unless expressly included in the signed Order Form. References to KHDA readiness do not represent certification, endorsement or a guarantee of inspection outcome.
3. Accounts and authorised users
- Accounts may be used only by users authorised by the subscribing school.
- Credentials must not be shared, transferred or used to bypass role restrictions.
- The school is responsible for maintaining accurate user roles and promptly disabling leavers.
- Suspected compromise must be reported promptly.
4. School responsibilities
The school is responsible for its lawful basis and notices for personal data, the accuracy and appropriateness of uploaded material, user permissions, required parental or learner communications, and decisions made using the service. The school must not upload unlawful content, malware, unnecessary sensitive data or content it has no right to use.
5. Orders, fees and payment
The binding price, currency, VAT treatment, payment schedule and renewal terms appear in the signed Order Form or invoice. Unless stated otherwise, fees are for the agreed term and exclude applicable taxes.
Access may be limited after reasonable notice if undisputed fees remain overdue. Billing disputes should be raised promptly with enough information to investigate.
6. Ownership and licence
EEP EdTech and its licensors retain ownership of the platform, software, design and documentation. The school retains ownership of its uploaded content and educational records. The school grants EEP EdTech the limited rights necessary to host, process, back up and display that content solely to provide and secure the service.
Feedback may be used to improve the service without identifying the school or disclosing confidential information.
7. AI-supported functionality
AI output can be incomplete or inaccurate. Authorised staff must review output before use. AI must not be the sole basis for grading, safeguarding, disciplinary, admission or other high-impact decisions about a person. Provider, retention and location details are documented in the school agreement or DPA.
8. Support, changes and availability
Support channels and service targets are stated in the Order Form. We may make reasonable changes for security, legal compliance and product improvement. Material reductions to contracted functionality will be communicated and handled under the school agreement.
Planned maintenance, third-party outages, internet failures and events outside reasonable control may affect availability.
9. Suspension, termination and data return
Either party may terminate as allowed by the signed agreement. We may suspend access where necessary to contain a security risk, prevent unlawful use or address material breach, using proportionate measures and notice where reasonably possible.
Export, retrieval and deletion of school data follow the DPA and the Privacy Notice. Refund eligibility follows the signed Order Form.
10. Liability
Liability limits and exclusions for a paid school subscription are set out in the signed agreement. Nothing in these terms excludes liability that cannot lawfully be excluded. The service supports professional judgement and does not replace the school’s legal, safeguarding, educational or regulatory responsibilities.
11. Governing law and contact
Unless the signed agreement states otherwise, these terms are governed by the laws applicable in the Emirate of Dubai and the federal laws of the United Arab Emirates. The courts of Dubai have jurisdiction, subject to any agreed dispute-resolution procedure.
Questions may be submitted through the contact page.
